What to do when the dealer runs off with the $$

Here's the situation...

:-/  :-(  :-[  :'(

... a cash deposit was put down upon the order of spa with the remainder due upon delivery; invoice was written. The tub was ordered and sits in the manufacturere's warehouse. The dealer has since lost their dealership and is no longer authorized to purchase athough *appears* to still be in business. This was learned from contacting the manufacturer - the dealer in this case has not been forthright thus far.  

Any suggestions on how to go about getting the money back?
How about some ideas on how to get the "old" dealer to cooperate with the new local dealer to complete the purchase?

Dealer should issue a refund.  Have they refused?

If so, file a small claims court case, and get a judgement against the place.

They lied about delivery, have refused to return calls and are not in the store. I am soliciting suggestions in an attempt to avoid filing if possible.

I would file. And do so quickly. I doubt anyone will get anything once he is settled in a new community.

You didn't mention what percentage you put down. I only mention because I would think the manufacturer might want to help out to protect their reputation.

I saw that happen when I lived in Texas. Manufacturer wouldnt help, dealer said sorry out of my hands. So .... The consumer and his family made picket signs and walked in front of his store for hours for a week before he finally caved in and gave up the deposit. A little extreme I know, but you do what you gotta do.

Thanks all for the support here and the IMs.

The dealer is Dr. Jekyll incarnate thus the "legal process" has begun.

The manufacturer has been incredibly helpful in doing everything they possibly can to assist and the support of other dealers has been stellar to say the least.

When it's all said and done - I am SO glad that I shopped the brand. My choice in Marquis could not have been a better one!

p.s. no boxcutters were involved

I hope it will be resolved for you soon.

My dealer quit selling tubs (they sell pools and ponds) shortly after I bought my tub, but they have still given me superior service.  I know the manufacturer will stick behind me, too!  Too bad they can't all be like mine, or the other dealers who frequent this board!!!
