Common sense prevails.  Ruling was as it should be.
 Surprised that the police didn't have anything better to do- you'd think that would't merit much other than a warning to watch it.

I thought "watching it" was the problem in the first place.
If you can't sell it on eBay, it may not even qualify as landfill.

Seems to me the law used to favor the homeowners and not the "peeping Toms".

they were thinking that the hot water seemed SO inviting.....and relaxing....and stirred up the ol' hormones, like a witches brew, and they couldn't help themselves!!
Maybe the neighbors made it a point to keep an eye on the tub, "just in case". I'd be willing to bet that our back yard (especially the part with the tub) gets a quick look from most everyone passing, just to see if anyone's actually using the tub....maybe a 'quick peek'....although, having 3 dogs running around the yard that the neighborhood kiddies love doesn't help to keep attention away....hmmm ::)

Yeah, sounds like there is more to this than just a cop answering a complaint.
 Sounds like a vendetta type of thing is being alleged.  
When a cop has to sue his own department, something is fishy.

Or her own department. ;)  Perhaps that is a clue.:-?  There must be a back story, since prosecutors took something like this to trial.  Maybe the Sheriff has an agenda.
