Safety - do we have to have a rail by a drop-off

Hi,
We want to put a tub above a small creek, up against the retaining wall at the top of the slope above the creek.  The retaining wall is about 6' tall.  We plan to put gravel down, maybe with pavers over it, against the top of the retaining wall and put the tub on top.    It's on a somewhat steep, terraced slope.  So, the tub would effectively be nestled between retaining walls (one above, one below), on a terrace.  There would be a deck on one side, and nothing on the two sides overlooking the creek, so there would be a drop off there (except we'll put a privacy screen blocking one side), but it would still be against a "wrap-around" retaining wall on those two sides, with a drop off on one side of the tub.

a) Are there safety rules/guidelines/commmon laws about hot tubs against the edge of drop-offs?   

b) Has anyone installed a tub above a sturdy, heavy retaining wall/drop off or something along these lines?  Any stories, warnings, successes, tips?
